1. Refund Policy

• All lesson package purchases are non-refundable.
• Lessons may be transferred to another family member or friend, but no cash refunds will be issued.
• Lesson packages do not expire, but we reserve the right to modify scheduling availability.
• Weather-related cancellations will be rescheduled at no charge.
• No-shows or cancellations with less than 24 hours' notice will result in forfeiture of that lesson.

2. Behavior Guidelines

• Swim diapers are required for children who are not fully potty-trained.
• Parents/guardians must supervise children before and after lessons.
• The instructor reserves the right to end a lesson early if safety is compromised.
• Verbal or physical aggression will not be tolerated and may result in removal without refund.

3. Release and Waiver of Liability

In consideration of being allowed to participate in swimming lessons, the undersigned acknowledges and agrees: (1) Assumption of Risk: Swimming involves inherent risks including drowning, injuries, and waterborne illness. I voluntarily assume all such risks. (2) Waiver and Release: I release and forever discharge The Swim Whisperer of Beverly Hills, its owners, instructors, employees, and affiliates from any liability, claims, or causes of action arising from participation. (3) California Civil Code Section 1542 Waiver: I expressly waive rights under Section 1542.

4. Parental Involvement

For children under 3, a parent/guardian is required in the water during the lesson. Parents must remain on-site during all lessons.

5. Indemnification

I agree to indemnify and hold harmless The Swim Whisperer of Beverly Hills from any claims arising from participation.

6. COVID-19 Waiver

I acknowledge that participation may increase the risk of contracting COVID-19 or other communicable diseases and voluntarily assume this risk.

7. Photo / Likeness Consent

I grant permission to use photographs, videos, or recordings for marketing and promotional purposes.
